The baby boy, born on November 30 at Max Hospital, died at a nursing home in Pitampura on Wednesday. "On Wednesday afternoon, he was officially declared dead", said Deepak, the baby's uncle.

The Indian Medical Association weighed in on the case, issuing a warning for hospitals that a body's metabolism can be "suspended" in cases of severe hypothermia and may protect against oxygen deprivation for an extended period of time.

Mr. Jain said the hospital had also misused the government's permission to increase beds by 10% for fever patients. But the hospital said that the premature twins were stillborn.

In a case of alleged medical negligence, one of the newlyborn twins was declared dead by Max Hospital in Shalimar Bagh on November 30 and was later found to be alive when the parents were on their way to perform the last rites.

Meanwhile, the case has been transferred to the crime branch and the northwest district police has been asked to hand over the files.

"We are shaken and concerned at this rare incident", said a spokesperson for the private Max Hospital. And, to shift a newborn in such a condition is a very hard task.

"We want the Delhi government to take strict action against the hospital authorities for their negligence", the boy's grandfather previously told CNN. Max Hospital, in a statement on Wednesday said, "We just learnt of the sad demise of the 23-week preterm baby, who was on ventilator support".

Max Healthcare, which runs a chain of hospitals including the one in Shalimarbag, expressed condolences to the parents.

The Delhi government's preliminary inquiry report was submitted to the Delhi health minister on Tuesday; it found the hospital guilty of not having followed prescribed medical norms when dealing with newborn infants, a Delhi government official who was not authorized to speak on the record about the report told CNN. "We wish them the strength to cope with their loss".
