SC extends deadline for Aadhaar linking till verdict

  • Chief Justice Dipak Misra had on 7 March said it may not be possible to decide by 31 March the batch of petitions challenging the constitutional validity of the Aadhaar Act

The Supreme Court on Tuesday extended the deadline for linking of various services with Aadhaar till it delivers its judgment on its constitutional validity of the biometrical identification scheme. Earlier, the deadline for mandatory linking of Aadhaar card to avail of the benefits of various welfare schemes was set at March 31.

Earlier, senior advocate Shyam Divan, who led the arguments challenging Aadhaar and its enabling Act, had asked that the deadline of March 31 be extended as it was highly unlikely that the hearing in the case would conclude.

"Mr. K.K. Venugopal, learned Attorney General for India submitted that this Court may think of extending the interim order".

The SC bench comprises of chief justice Misra, jutices AK Sikri, AM Khanwilkar, DY Chandrachud and Ashok Bhushan. "We accept the same". This hampers the basic part of the Constitution i.e. the federal structure, Chidambaram argued. Last week, Centre had told the Supreme Court that it may extend the deadline to link Aadhaar with bank account and mobile numbers.

U.S. notes Taliban 'interest' in peace talks
But the Taliban has so far ruled out direct talks with the Western-backed government, which they say is illegitimate. The insurgent group has said it was prepared to negotiate, but only with the USA and not with the Kabul government.

It was passed on 11 March 2016 by the Lok Sabha.

The court made it clear that the extension of the time limit beyond March 31, 2018 shall apply for Aadhar linkage, besides the schemes of the Ministries/ Departments of the Union government and all state governments in similar terms. The government, in its defence, had insisted on quoting Aadhaar for bank deposits for obtaining mobile phone and several other utilities to weed out corruption and tighten its grip on the black money floating in the country. He proceeded to submit that other ID's such as the voter ID, Electricity bills etc. are being taken into consideration.

The matter will be heard again tomorrow.
