Supreme Court rejects appeal from Middle East attack victims

  • Light from the setting sun shines on the Supreme Court in Washington DC U.S

In the midst of the ongoing Stephon Clark shooting scandal in Sacramento and the Baton Rouge Police Department's decision regarding the officer who shot and killed Alton Sterling, the United States Supreme Court made what will likely prove to be an unpopular decision on Monday. Hughes did not respond to orders to drop the knife as she walked toward Chadwick, and Kisela opened fire, according to court records.

The court declined to hear the families' appeal of a lower court's 2016 ruling that threw out the jury award secured in a lawsuit under the Anti-Terrorism Act, a law that lets American victims of global terrorism seek damages in USA courts.

Kisela then appealed to the Supreme Court, which backed him Monday.

"Kisela alone resorted to deadly force in this case", she wrote. The San Francisco-based 9th U.S. Circuit Court of Appeals reversed that ruling, saying the record did not support Kisela's perception that Hughes posed an immediate threat. They arrived and saw Hughes holding a knife.

Officers were called to Amy Hughes' house following a report that someone was hacking a tree with a knife. "Confronted with the same circumstances as Kisela, neither of his fellow officers took that drastic measure".

On Friday a Baton Rouge, Louisiana police officer was sacked but not otherwise punished for the 2016 shooting of Alton Sterling, a 37-year-old black man.

In the case decided on Monday, the court ruled in an unsigned opinion that Kisela was entitled to qualified immunity protecting him from the litigation because he did not violate any clearly established law.

An autopsy showed he was shot eight times, mostly in the back, by officers investigating vehicle thefts.

The Supreme Court says the officer was immune from being sued by Hughes.

The court majority's decision "sends an alarming signal to law enforcement officers and the public". "It tells officers that they can shoot first and think later, and it tells the public that palpably unreasonable conduct will go unpunished", Sotomayor added.
