An appellate court in NY on Thursday denied President Trump's attempt to put a defamation lawsuit on hold as he continues to seek to have the case, brought by a former contestant on "The Apprentice", dismissed.

With just four sentences, the appellate court rejected Kasowitz's appeal in its decision, concluding, "Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, it is ordered that the motion is denied".

Zervos has said those denials amounted to defamation.

As noted by CNN, the appeal was made on March 20 by Trump's lawyer, Marc Kasowitz, who asked the appellate court to determine what would constitute immunity for a president who is now in office, as indicated on the Constitution's Supremacy Clause.

In the meantime, Zervos's lawyer can continue demanding that Trump give a deposition and turn over documents while the case proceeds.

Zervos, a California restaurateur, appeared on "The Apprentice", Trump's former show, in 2006.

Trump's legal team, led by Marc E. Kasowitz, wouldn't let this decision slide, and turned to the New York Court of Appeals to put the case on hold.

Kasowitz said the NY appeals court's decision to deny a stay was "completely and unjustifiably contrary to the stays the courts uniformly granted" as Clinton's case moved through the courts.

Stormy Daniels, a pornographic film actress whose real name is Stephanie Clifford, is seeking to end an agreement in which Trump's personal lawyer Michael Cohen paid her $130,000 not to discuss her alleged affair with Trump. The subpoena from Zervos' lawyers also demands records from the Beverly Hills Hotel from 2005 through 2009, as well as "all video recordings that depict the entrances, common areas, or bungalow areas" of the hotel from December 2007.

The ruling is an encouraging sign to Mariann Wang, who replaced Gloria Allred as Zervos's representation after the famous feminist attorney withdrew from the case in March.

"No one is above the law", she wrote at the time. Trump had argued the supremacy clause required the suit to be stayed.

"This case is going forward", he said.
