Gabriel Fernandez: Death penalty in US boy's 'beyond animalistic' murder

Fernandez's boyfriend, Isauro Aguirre, was convicted of first-degree murder on November 15 and a jury found true the allegation that the defendant tortured the victim.

The mother of an 8-year-old Palmdale boy was sentenced to prison for life and her boyfriend will be sent to California's death row for the child's horrific torture death, a case that the judge called "nothing short of evil".

Her boyfriend, 37-year-old Isauro Aguirre, was found guilty of murder last year after the court found he intentionally tortured the child.

The 8-year-old died two days later from blunt-force trauma and neglect.

According to medical officials, Gabriel was routinely beaten, shot with a BB gun, fed cat feces and forced to sleep while gagged and bound inside a small cabinet, which prosecutors displayed in court.

In denying an automatic motion to reduce the jury's recommendation of a death sentence for Aguirre to life in prison without the possibility of parole, the judge cited the "repeated beating, binding, burning and starving" of the boy.

Pearl's life imprisonment without chance of parole followed the mother pleading guilty February 15 to first-degree murder and admitting torture of her son, She had been facing a possible death sentence if the case against her had gone to trial and found guilty.

During the trial, Gabriel's siblings testified that Fernandez and Aguirre punished the boy because they thought he was gay.

A jail chaplain who met with Fernandez told the court that she loved her son and is a different woman today than when she walked into jail. "I don't think anybody should have to go through that again, to see those pictures to see what they did to him", Carranza told reporters, noting that she was "okay" with the decision by the District Attorney's Office to go forward with the plea "because I know she's never going to be out and I know she's never going to be able to hurt another child".

"For eight straight months, he was abused, beaten and tortured more severely than many prisoners of war", Deputy District Attorney Jonathan Hatami told the grand jury.

Fernandez's son, Gabriel, was killed in a "beyond animalistic" way in 2013. "I find comfort in believing he is now at peace", she said.

The prosecutor called Aguirre "evil".

Two social workers and supervisors were fired as a result of the repeated missed chances to save Gabriel. They are awaiting trial on one felony count each of child abuse and falsifying public records involving the boy.
