Pizza delivery man granted emergency stay against deportation

A federal judge in NY has temporarily halted the deportation of a pizza delivery driver who was detained earlier this month while out on a delivery. He is in Immigration and Customs Enforcement custody pending removal from the country.

"Please ICE, do the right thing with my husband", his wife Sandra Chica said earlier this week, CBS New York reports.

Villavicencio, who worked at Nonna Delia's pizzeria, an hour away by vehicle in Queens, produced a city identification card, but the official told him he wanted to see a state driver's license, Chica said. Villavicencio's wife told The New York Times that the personnel at the base still accepted the food he had delivered.

A representative at the base told HuffPost that a routine background check was performed on him, which Villavicencio consented to.

Chica said Luciana was especially crushed on Friday when she "heard a noise outside where the garbage is, and she got so happy".

In response to Villavicencio's arrest, New York Gov. Andrew Cuomo wrote two letters to high-ranking officials calling for an investigation into ICE and for Villavicencio's release. He said that a state-provided attorney had talked with Villavicencio, who is being held at a New Jersey facility.

Cuomo said Villavicencio is a taxpayer who has lived in NY for more than 10 years.

"I don't know if it's going to be good or not to tell them the truth".

Chica is a U.S. citizen and they have two young daughters who were born in the United States.

"As a result of military police action at the Fort Hamilton Army Base, in accordance with the Department of Army Access Control standards for all visitors, an individual with a warrant was identified upon seeking entrance to the Fort", said Golden, a member of the Senate Committee on Veterans, Homeland Security and Military Affairs.

'Is our city or our nation any safer now that Pablo the pizza delivery man is off the streets?' Brannan asked.

"Immigrant New Yorkers like Pablo Villavicencio provide for their families by working hard and making sacrifices, they shouldn't be ripped from their communities and their crying children for pursuing the ever dimmer American dream", he said.

"As such, his voluntary departure order became a final order of removal", she said.

A statement issued by Fort Hamilton last Friday said Villavicencio attempted to make a delivery about 11 a.m. but lacked identification required to enter.

"What prompted them to call ICE?" she asked.
