Unity might be willing to make exceptions for games that are live, but titles that are still in-development are likely in trouble.
In a phone interview with The Register, Daniel Griffiths, head of communications for Improbable, said he couldn't provide any insight into why Unity singled the company out. Specifically, the clause now bars external services who use cloud-based technology.
The newly updated now specifically excludes "managed service [s] running on cloud infrastructure" which "install or execute the Unity Runtime on the cloud or a remote server".
Other developers are awaiting clarification about how their games will be affected. Improbable said Unity has hurt projects across the industry, particularly among smaller developers, leaving games in legal limbo.
The change coming to light has been met with immediate backlash from game developers, with even one of Unity's forum moderators making it clear they're not too pleased with the company's failure to communicate such a change ahead of time. "I can't fathom how anyone will be able to trust Unity if they're ready to do this", he said.
The developer community has been thrown into chaos after Unity changed its Terms of Service to render all games made with Improbable's SpatialOS in breach of Unity's licence, before Epic Games stepped in to announce it would partner with Improbable to create an open integration between SpatialOS and the Unreal Engine. "You couldn't operate Fortnite, PUBG, or Rocket League under these terms".
In September that year, after lobbying from developers and game companies, Apple reconsidered and revised the wording of its rules to allow apps created with any development tools so long as the apps didn't download executable code.
While everyone's hoping this is ssa breakdown in communication on Unity's part, the company behind SpatialOS is taking multiple steps to work with clients to keep their games working.

Licensing changes affecting proprietary products like Unity can be a worse-case scenario for developers dependent on the technology. In a statement emailed to The Register, Unity CTO Joachim Ante disputed Improbable's version of events. 'We terminated our relationship with Improbable due to a failed negotiation with them after they violated our Terms of Service. That means all games using both platforms, whether they're live or in-development, are now in breach of Unity's license terms. Improbable also says it is continuing to talk to Unity in an effort to reverse the decision, though its license to work with the Engine has now been revoked.
An Improbable spokesman told Business Insider that it was hard to estimate the potential financial impact on the startup, but added that the situation with Unity was "unique". "This was the only course of action to protect the integrity and value of our technology and Unity developers".
"We are genuinely disappointed that we have been unable to come to an agreement with Improbable, and their improper use continued until we took the action we did".
The change is a blow, but won't impact all games running on SpatialOS.
The firm wrote "For now, we believe this unfortunate and counterproductive action to be an error in judgement or coordination failure within Unity".
