The Republican operative's lawyers were making a case for why Stone shouldn't be restricted by a gag order in the months leading his court trial, which will address special investigator Robert Mueller's charges that Stone lied to Congress and obstructed its Russian Federation investigation.

Lawyers for Stone, a political consultant who has made a career out of attention-seeking, bare-knuckles politics, say in a new court filing that any limits on their client's public comments would infringe on his First Amendment right to free speech.

U.S. District Judge Amy Berman Jackson is considering issuing one that would prevent both sides in the case from making public statements that could have a prejudicial effect on potential jurors while allowing Stone to publicly opine on other matters.

His speech shouldn't be restricted, because his lifeblood is writing and speaking about politics and fashion, his attorneys say.

Stone faces charges of making false statements to Congress, obstruction and witness tampering in Special Counsel Robert Mueller's probe into Russia's role in the 2016 USA election and whether Trump's campaign conspired with Moscow.

The judge was assigned Stone's case because of its relation to a hacking indictment case in which she also presides. In their reply, prosecutors with Mueller's team and the USA attorney's office for the District of Columbia did not oppose an order, citing a "substantial likelihood" that out-of-court comments will undermine a fair trial.

"Whether it is his pursuit of a posthumous pardon for Marcus Garvey, or the style of his clothes, or the state of the Nation, Roger Stone is a voice", his attorneys wrote.

Prosecutors have yet to respond to either of Stone's filings.

Stone was arrested last month as part of special counsel Robert Mueller's investigation.

Jackson so far hasn't had much face time in court with Stone or his legal team to reveal her approach to the case.

Moscow has repeatedly denied the allegations.
