Qualcomm defeats Apple in iPhone patent case

Another addressed faster downloads and the third covers battery life and graphics processing. During an eight-day trial, Qualcomm asked the jury to award it unpaid patent royalties of up to $1.41 per iPhone that violated the patents.

But anorther legal decision involving Qualcomm and Apple was announced today.

"Next month's case on licensing [between Apple and Qualcomm] will affect billions of dollars in fees that Apple and most phone vendors pay Qualcomm", Greengart said.

Qualcomm and Apple have been duking it out in courts around the globe with respect to patents and licensing agreements.

"The technologies invented by Qualcomm and others are what made it possible for Apple to enter the market and become so successful so quickly", Don Rosenberg, Qualcomm's general counsel, said in a statement. We are gratified that courts all over the world are rejecting Apple's strategy of refusing to pay for the use of our IP. Apple said it was disappointed with the decision.

On another front in the complex legal battle between two United States companies a federal judge in Southern California on Thursday issued a preliminary ruling that Qualcomm owes Apple almost a billion dollars in patent royalty rebate payments the chip maker is withholding, according to USA media reports. It declined to comment on whether it would appeal.

It's hard to believe the arrangement between Qualcomm and Apple was established in the first place.

For Qualcomm, it shows the San Diego-based company's contribution to the iPhone's success and sets up an even bigger trial against Apple over billions of dollars in patent royalties.

Apple and Qualcomm have other court cases to come, including a trial that is scheduled for April.

Qualcomm in turn alleged that it stopped paying the rebate payments because Apple had broken the agreement by urging other smartphone makers to complain to regulators and making "false and misleading" statements to the Korean Fair Trade Commission, which was investigating Qualcomm over antitrust allegations.

The jury agreed with Qualcomm's contention that it should be paid $1.41 per iPhone relying on three of its patents.

"Apple is very skilled at handling appeals and taking a longer-term view".

Gaston Kroub, a patent lawyer in NY not involved in the case, said the verdict was clearly a win for Qualcomm.
