There was no smoking gun but the documents showed Foxx was kept in the loop on - and commented to her staff about - a case in which she publicly claimed to have recused herself.

Foxx went on in those texts to Magats to compare Smollett's case to the office's pending indictment of R&B singer R. Kelly on 10 charges of aggravated criminal sexual abuse.

Foxx had originally recused herself from the case because she said she had conversations with a family member of Smollett when she still thought Smollett was the victim of a crime.

It all comes after Smollett's alleged hate crime hoax and in light of him being sued by the city of Chicago after he failed to pay $130,106 for what he cost the city investigating the alleged hoax. But a week later the head of the State's Attorney's Appellate Division issued a memo stating his opinion that if Foxx recused herself, Foxx didn't get to pick who took over the prosecution, and it was up to the court to appoint a special prosecutor.

Foxx had stepped aside because of conversations she'd had with a relative of Smollett's in the weeks before Smollett was charged. Foxx's office has since said that when an interoffice email to senior staff stated that Foxx was "recused" in the case, the term was used in a colloquial, not a legal definition.

In a written statement released Tuesday night, Foxx said she only wanted to ensure that the office's charging practices were consistent across different cases. Eddie Johnson to turn the case over to federal investigators.

Foxx and Magats continued to communicate via text message about aspects of the investigation. Foxx's office created a firestorm of protest after abruptly dropping all the charges less than three weeks later at a court hearing that reporters only learned about at the last minute.

Smollett has insisted that he told the truth about the attack. "Paying $10k restitution to city, and completed community service". While Smollett will no longer appear in the play, Empire actress Taraji P. Henson has said Jussie will return to the Fox Entertainment program next season despite the ordeal.

The text messages also appeared to show that prosecutors notified Chicago police moments before the charges were dropped against Smollett, the Tribune reported.

However, Johnson and Mayor Rahm Emanuel held a news conference that morning slamming the decision - "a whitewash of justice", the mayor said.
